2. Products and Pricing
Argo Archives specializes in high-end timepieces, including new, pre-owned, and vintage luxury watches. We take great care to describe and photograph each piece accurately, including details regarding condition, provenance where available, and accompanying documentation.
All prices are listed in euros (EUR) unless otherwise stated and may be subject to change without prior notice. A listed price is only binding once we have confirmed your order in writing. Obvious errors or typographical mistakes in pricing or product descriptions may be corrected by us, and we reserve the right to cancel orders based on such errors.
Availability of specific watches is strictly limited. A watch may be sold to another client before your order is completed or confirmed. In such cases, we will inform you promptly and, if applicable, offer alternatives.
3. Orders and Payment
Placing a watch in your cart or submitting an inquiry does not constitute a binding contract. A binding purchase contract is only formed once we have confirmed your order in writing (for example, by email) and you have completed payment within the agreed terms.
We reserve the right to decline or cancel any order at our discretion, including in cases of suspected fraud, incomplete information, regulatory restrictions, or where we are unable to verify your identity or payment details to our satisfaction.
Accepted payment methods and any additional conditions (such as deposits, bank transfer requirements, or payment deadlines) will be communicated during the ordering process or in our written confirmation. You are responsible for any bank charges, currency conversion fees, or additional costs imposed by your payment provider.
4. Shipping, Delivery, and Risk
We ship from Vienna, Austria, using reputable logistics partners and, where appropriate, insured shipping methods. Shipping options, estimated delivery times, and costs will be communicated prior to order confirmation and may vary depending on destination, value, and specific security requirements.
Any delivery times provided are estimates only and are not guaranteed. We are not liable for delays caused by customs, carriers, or other circumstances beyond our reasonable control.
Risk of loss and damage to the watch passes to you upon delivery to the address you have provided, or upon handover to you or your representative in the case of in-person collection. You are responsible for complying with all applicable customs, import, tax, and regulatory requirements in your jurisdiction.
5. Returns and Right of Withdrawal
Given the nature, value, and scarcity of our timepieces, returns are handled with particular care. Your statutory rights under applicable Austrian and EU consumer protection laws remain unaffected where you qualify as a consumer.
Details of your right of withdrawal (if applicable), any exclusion of withdrawal for custom or specially sourced pieces, and the practical return process will be provided to you in our pre-contractual information and order confirmation. In all cases, watches must be returned in the same condition as delivered, including all accessories, documentation, and packaging, and must be properly insured and packaged for transit.
We reserve the right to refuse a return or reduce any refund where a watch has been worn, altered, damaged, or otherwise diminished in value while in your possession, except to the extent required by applicable consumer law.
6. Condition, Authenticity, and Warranties
Each watch is inspected with the utmost care. Unless expressly stated otherwise, pre-owned and vintage watches may show signs of wear consistent with their age and history. Any condition descriptions are our professional opinion and are not exhaustive.
Authenticity is central to our work. Where applicable, we provide documentation, certificates, and service records available to us. However, unless explicitly agreed in writing, we do not provide a manufacturer warranty and are not responsible for future maintenance, servicing, or performance of timekeeping beyond any mandatory legal warranties that may apply.
To the maximum extent permitted by law, any additional guarantees, whether express or implied, are excluded, except where specifically confirmed in writing.
7. Liability Limitations
Nothing in these Terms limits or excludes our liability for intent, gross negligence, injury to life, body, or health, or any other liability that cannot be limited or excluded under mandatory law.
Subject to the foregoing, our liability for slight negligence is excluded. In any event, our overall liability in connection with any individual transaction is limited to the amount you have paid for the watch concerned.
We are not liable for indirect or consequential losses, including loss of profit, loss of opportunity, or loss of value, nor for fluctuations in market value of any watch you purchase from us. You acknowledge that luxury watches can rise or fall in value and that we do not provide investment advice.
8. Website Use and Intellectual Property
All content on our website, including images, descriptions, text, design, and logos, is owned by or licensed to Argo Archives and protected by intellectual property laws. You may not copy, reproduce, distribute, or otherwise use any content without our prior written consent, except for personal, non-commercial viewing.
We do not guarantee continuous or error-free access to our website. We may suspend, restrict, or modify the website at any time, particularly for maintenance, security, or business reasons.
9. Governing Law and Jurisdiction
These Terms and any disputes arising out of or in connection with your use of our website or purchase of our watches are governed by and construed in accordance with the laws of Austria, without regard to its conflict of laws rules.
For business customers, the exclusive place of jurisdiction is the competent court in Vienna, Austria. For consumers, any mandatory provisions on jurisdiction under applicable consumer protection laws remain unaffected.
